Creator Terms of Service
Effective May 1, 2026
These Creator Terms apply to anyone who publishes content on Vizno. They are in addition to the Vizno Terms of Service, Privacy Policy, and Content Policy. Read them carefully — they include indemnification, limits on liability, a binding arbitration provision, and a class action waiver.
These Creator Terms of Service (the “Creator Terms”) govern your relationship with Vizno LLC (“Vizno”, “we”, “us”, or “our”) when you publish content on Vizno as a creator.
These Creator Terms are in addition to, and incorporate by reference, the Vizno Terms of Service, the Privacy Policy, and the Content Policy. By creating a creator or vendor account, by publishing content on Vizno, or by accepting these Creator Terms in the Service interface, you accept these Creator Terms. If you do not agree, do not publish content on Vizno.
1. Relationship between you and Vizno
You are an independent creator and Vizno is a hosting and distribution platform. Nothing in these Creator Terms creates an employment, agency, partnership, joint venture, or fiduciary relationship between you and Vizno. You are solely responsible for your content, your tax obligations, and your compliance with applicable law.
You are not entitled to any benefits, insurance, or compensation available to Vizno employees. You determine when, where, and how you create content and conduct your activities, subject only to the requirements of these Creator Terms and the Service.
2. Eligibility
To publish content as a creator on Vizno, you must:
- be at least 18 years old, or the age of majority in your jurisdiction (whichever is greater);
- have the legal capacity to enter into binding contracts and to grant the rights granted in these Creator Terms;
- not be located in, ordinarily resident in, or a national of any country subject to U.S. trade sanctions or embargo, and not be on any U.S. government list of prohibited or restricted parties;
- own, or have valid rights to, all content you publish on Vizno;
- comply with all applicable tax, intellectual property, consumer protection, advertising, and content-related laws.
For adult content (defined in Section 8), you must also meet the additional eligibility and verification requirements described in that Section.
3. Account creation, verification, and tax forms
You must provide accurate identifying information when registering as a creator and update it as it changes. We may require additional verification before you publish or as a condition of continued publication, including:
- identity verification (such as government-issued photo identification);
- tax form submission (a Form W-9 if you are a U.S. person, or a Form W-8BEN or W-8BEN-E if you are a non-U.S. person), and any additional tax information required by applicable law;
- payment account information for payouts when monetization is enabled;
- for adult content: the additional verification described in Section 8.
You are responsible for keeping all information current. We may refuse, suspend, or terminate creator status at our sole discretion if any of the above is incomplete, inaccurate, or out of date.
4. Your content; license to Vizno
4.1 You retain ownership
You retain ownership of all original copyright, trademark, and other intellectual property rights in the content you create and publish on Vizno (your “Creator Content”). Nothing in these Creator Terms transfers ownership of your Creator Content to Vizno.
4.2 License to Vizno
You grant Vizno a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (for the technical purposes described below), publicly display, publicly perform, distribute, and promote your Creator Content for the purpose of operating, marketing, and improving the Service.
This license includes:
- conversion of your Creator Content into Vizno’s canonical project format and any subsequent format adaptations needed for browser playback, accessibility, or platform compatibility;
- generation and display of preview images, descriptions, and other promotional excerpts from your Creator Content;
- inclusion of your Creator Content in the Vizno catalog, recommendations, curated collections, search, and personalized discovery surfaces;
- promotion of your Creator Content on Vizno-controlled marketing channels, including social media operated by Vizno.
The license terminates with respect to public display and promotion when your Creator Content is removed from the Service, subject to:
- a reasonable wind-down period for technical reasons (such as caching and backups);
- continued use of aggregated, anonymized analytics derived from your Creator Content;
- continued use of any Creator Content provided to end users before removal, where applicable;
- compliance with legal retention obligations.
4.3 Feedback
If you provide feedback, suggestions, or ideas about Vizno or the Service, we may use them without restriction or compensation.
5. Your representations and warranties
You represent and warrant to Vizno that:
- you own or have all necessary rights, licenses, consents, and permissions to publish your Creator Content and to grant the license in Section 4.2;
- your Creator Content does not infringe any third party’s intellectual property, privacy, publicity, contract, or other rights;
- your Creator Content complies with all applicable laws, including consumer protection, advertising, intellectual property, child protection, and obscenity laws in jurisdictions where the content is made available;
- your Creator Content complies with the Vizno Content Policy and these Creator Terms;
- any third-party assets included in your Creator Content (such as images, audio, fonts, and software libraries) are properly licensed for the use you are making, and you can produce records of those licenses on request;
- your Creator Content does not contain malicious code, viruses, or technical mechanisms designed to disrupt the Service or other creators’ content;
- you are solely responsible for your Creator Content regardless of whether you used AI tools (including the Aldus authoring assistant or any third-party AI tool) in its creation, and you have reviewed and verified the final Creator Content before publication; AI tool output is not a defense to a breach of these Creator Terms or the Content Policy;
- you will not encourage, instruct, or facilitate end users to initiate payment-card chargebacks, refunds, or transaction disputes for Vizno purchases of your Creator Content as a substitute for legitimate refund or cancellation channels; you will not sell or distribute the same Creator Content off-platform in a manner intended to induce Vizno-side payment disputes;
- for any content depicting real, identifiable individuals: each such individual has provided written consent for the depiction, you have verified their age where required by Section 8, and you can produce that consent and verification on request;
- you are not subject to any contract, court order, or other legal restriction that would prevent you from publishing your Creator Content or granting the rights granted to Vizno in these Creator Terms;
- all information you provide to Vizno (including identity verification, tax forms, payout information, and any attestations) is true, complete, and current.
6. Content moderation; Vizno’s rights
Vizno may, but is not obligated to, review Creator Content for compliance with these Creator Terms and the Content Policy. We do not pre-screen Creator Content and do not guarantee review of any Creator Content. We may, at our sole discretion and with or without prior notice:
- decline to publish Creator Content;
- remove, restrict access to, or modify the visibility of Creator Content;
- require you to make changes before publication;
- impose geographic restrictions where required by law;
- suspend or terminate your creator account;
- report Creator Content to law enforcement where required by law or where we reasonably believe it is necessary to protect others.
We will use reasonable efforts to notify you of significant moderation decisions and provide an explanation. We are not obligated to publish or continue to host any Creator Content.
Vizno may use information about moderation decisions and flagged content (including aggregated and de-identified data and content samples) to improve its enforcement systems, including the training, tuning, and evaluation of automated classifiers used for moderation.
Adult content carve-out. Notwithstanding the general non-pre-screening policy stated above, Adult Creator Content is subject to mandatory pre-publication review as described in Section 8.6. The general non-pre-screening policy applies to non-adult Creator Content only.
Automated abuse detection.Vizno uses automated systems (including image-hashing technology comparable to PhotoDNA) to scan uploaded content for child sexual abuse material (CSAM) and other illegal material. Confirmed CSAM is reported to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement as required by 18 U.S.C. § 2258A. Vizno cooperates fully with lawful investigations.
User reporting. Users and content subjects can report Creator Content for violations of these Creator Terms or the Content Policy at reports@vizno.app or through the in-product report tool. We acknowledge reports within 2 business days, act on confirmed reports of illegal content (including CSAM and non-consensual intimate imagery) within 24 hours, and target resolution of other reports within 7 days.
Appeals. If your Creator Content is removed or restricted, or if your creator account is suspended or terminated for a content-policy reason, you may appeal by emailing appeals@vizno.app within 30 days of the decision. We review appeals on the merits and respond within 14 days. Appeals do not stay enforcement actions for content that violates law or that poses imminent harm.
7. Prohibited content
The following Creator Content is strictly prohibited and will result in content removal and may result in account termination, regardless of artistic intent or framing:
- any sexual or sexualized depiction of minors — real or fictional — regardless of stated character age, art style, or framing intent;
- bestiality, incest depicting real family relationships, or other content illegal under U.S. federal law;
- sexual content depicting real, identifiable individuals, including revenge pornography and deepfakes, except as specifically permitted under Section 8 with verified consent and required record-keeping;
- content that promotes, glorifies, or instructs real-world violence, sexual violence against real individuals, terrorism, or self-harm;
- content infringing third-party copyright, trademark, right of publicity, or privacy rights without permission;
- hate speech intended to incite violence against a protected class;
- content designed to deceive, defraud, or impersonate.
This list is not exhaustive and is supplemented by the Content Policy. Where these Creator Terms and the Content Policy differ, the stricter standard applies.
8. Adult content
Vizno permits lawful adult content depicting fictional adult characters, subject to the additional rules in this Section.
8.1 Age representation
All persons depicted in sexually explicit content must be at least 18 years old at the time of depiction (and at least the age of majority in your jurisdiction, whichever is greater). Content that visually represents, or is reasonably understood to represent, a minor in a sexual context is prohibited regardless of any character age stated in the narrative.
8.2 Real-person consent and 18 U.S.C. § 2257 record-keeping
If your Creator Content depicts actual sexually explicit conduct involving real, identifiable individuals (as those terms are used in 18 U.S.C. § 2257 and 28 C.F.R. Part 75), you are responsible for:
- maintaining the records required by 18 U.S.C. § 2257 and 28 C.F.R. Part 75 (including 28 C.F.R. § 75.6 and § 75.7 notice requirements as applicable) for each performer;
- obtaining and retaining a copy of each performer’s government-issued photo identification verifying that the performer was at least 18 at the time of the depiction;
- obtaining and retaining a written consent from each performer for the specific use of their depiction on Vizno;
- producing those records to Vizno on request, within the time we reasonably specify;
- making those records available to law enforcement to the extent required by applicable law.
You will indemnify Vizno for any liability arising from your failure to maintain or produce these records.
If your Creator Content consists solely of fictional, animated, drawn, or otherwise non-photographic depictions, the foregoing record-keeping requirements may not apply, but you must still warrant compliance with all applicable obscenity, age- representation, and consent laws in every jurisdiction where the content is distributed.
8.3 Tagging and rating accuracy
You must accurately tag your adult content using the Service’s content rating system. Failure to tag accurately is a breach of these Creator Terms and may result in removal, suspension, or termination.
8.4 Verification
Before publishing adult content for the first time, and from time to time thereafter, you may be required to complete additional creator verification. This may include:
- identity verification through a third-party service;
- attestation that you understand and comply with the requirements of this Section 8;
- attestation regarding 18 U.S.C. § 2257 records (where applicable);
- submission of representative records on request, subject to handling consistent with the Privacy Policy.
8.5 Jurisdictional restrictions
Adult content distribution is regulated differently across jurisdictions. Vizno will geo-restrict adult content where required by law (including jurisdictions with mandatory consumer-side age-verification laws for adult content, such as the United Kingdom under the Online Safety Act and U.S. states with adult-content age-verification statutes). You authorize Vizno to apply such restrictions to your Creator Content as needed for compliance with applicable law.
8.6 Pre-publication review
Adult Creator Content is subject to pre-publication human review by Vizno’s trust and safety team. Submissions are queued for review at the time you mark them ready for publication; we target review turnaround within 5 business days. Pre-publication review verifies that:
- age-representation requirements (Section 8.1) are met;
- for content involving real persons, the consent and record-keeping attestations of Section 8.2 are present and the referenced records are producible on request;
- content tagging and rating (Section 8.3) appear accurate;
- the content does not fall within the prohibited categories of Section 7.
Pre-publication review is a compliance gate, not an editorial endorsement, and does not transfer responsibility for Creator Content from you to Vizno. Vizno may revisit a publication decision at any time based on new information, including post-publication reports, automated flags, or audit findings.
9. Monetization
Monetization features (paid game purchases, episode unlocks, microtransactions, tokens / virtual currency, season passes, tips) may be made available to qualifying creators in the future. These features are subject to additional monetization terms, which will be incorporated by reference into these Creator Terms when monetization is enabled.
These Creator Terms govern the relationship between you and Vizno in advance of monetization and continue to apply once monetization is enabled, in addition to any monetization-specific terms then in force.
When monetization is enabled, the following will apply (subject to the specific monetization terms then in force):
- Revenue share: Vizno will retain a platform fee from creator earnings, with the remainder remitted to the creator. Specific rates will be specified in the monetization terms.
- Payouts: minimum payout thresholds, payout schedules, and supported payout methods will be specified in the monetization terms.
- Taxes: you are responsible for all taxes on your earnings. Vizno may withhold or report amounts as required by law and may require current and complete tax forms (Form W-9 for U.S. persons; Form W-8BEN or W-8BEN-E for non-U.S. persons) before issuing payouts.
- Refunds and chargebacks: amounts attributable to refunded or charged-back transactions may be deducted from creator earnings.
- Holds: Vizno may hold or delay earnings during fraud, dispute, or policy investigations.
- Currency conversion: where applicable, payouts made in a currency other than the creator’s payout currency will be converted at then-prevailing exchange rates, which may include conversion fees.
- Subscription cancellation: where you offer recurring subscriptions or season passes through Vizno, end users will be able to cancel using a process no more burdensome than the sign-up process, consistent with payment card network requirements and applicable consumer protection law.
- Chargebacks and resale: you will not sell or distribute the same Creator Content off-platform in a manner intended to induce Vizno-side chargebacks. Sustained chargeback ratios above network thresholds attributable to your Creator Content may result in suspension, termination, and offset against earnings.
10. Intellectual property; DMCA
You agree to respect the intellectual property rights of others. Vizno operates a notice-and-takedown process under the U.S. Digital Millennium Copyright Act. Send takedown notices and counter-notifications to our designated agent at:
- [DMCA Designated Agent name]
- [DMCA agent address]
- [DMCA agent email]
Repeat infringers may have their creator accounts terminated. Submitting a knowingly false takedown notice or counter-notice may result in liability under applicable law.
11. Indemnification
You will indemnify, defend, and hold harmless Vizno, its affiliates, and their respective officers, directors, employees, agents, and licensors from any third-party claim, demand, suit, action, loss, damage, judgment, fine, penalty, or expense (including reasonable attorneys’ fees) arising out of or related to:
- your Creator Content;
- your breach of any representation, warranty, or obligation in these Creator Terms or the Content Policy;
- your violation of any law or third-party right;
- your acts or omissions in connection with the Service.
Vizno will provide reasonable notice of any indemnified claim and cooperate at your expense in the defense. You may not settle a claim that imposes any obligation on Vizno or that admits liability on the part of Vizno without our prior written consent. Vizno may, at its option and at your expense, assume the exclusive defense and control of any matter subject to indemnification.
12. Disclaimers and limitation of liability
THE SERVICE IS PROVIDED TO CREATORS “AS IS” AND “AS AVAILABLE”. VIZNO DOES NOT WARRANT THAT THE SERVICE WILL GENERATE PARTICULAR LEVELS OF TRAFFIC, ENGAGEMENT, OR REVENUE, OR THAT IT WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
EXCEPT AS REQUIRED BY LAW, VIZNO’S TOTAL LIABILITY TO YOU ARISING UNDER OR IN CONNECTION WITH THESE CREATOR TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY VIZNO TO YOU IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS. IN NO EVENT WILL VIZNO BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOST PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES.
13. Audit rights
For Creator Content involving real persons or otherwise subject to record-keeping obligations under Section 8, Vizno may, on reasonable notice and not more than once per twelve-month period (except for cause), request copies of records you are required to maintain. You will respond within thirty days of the request. Audit information will be handled consistently with the Privacy Policy and used only for compliance and enforcement purposes.
14. Confidentiality
If we share confidential information with you (such as prerelease features, business plans, or non-public analytics), you will keep it confidential, use it only in connection with these Creator Terms, and protect it with at least the same care you use to protect your own confidential information of like kind.
15. Termination
15.1 Termination by you
You may terminate your creator account at any time through your account settings or by contacting Vizno. Termination does not relieve you of obligations accrued before termination, including indemnification obligations.
15.2 Termination by Vizno
We may suspend or terminate your creator account at any time for:
- breach of these Creator Terms or the Content Policy;
- conduct that exposes Vizno or other users to legal, financial, or reputational risk;
- failure to provide required identity, tax, or verification documentation;
- non-payment of amounts owed to Vizno;
- extended inactivity;
- discontinuation of the Service or the creator program.
15.3 Effect of termination
Upon termination of your creator account:
- your Creator Content will be removed from public availability, subject to a reasonable wind-down period for technical reasons;
- the license in Section 4.2 ends prospectively, subject to the carve-outs in that Section;
- earnings owed to you (if any) will be paid in accordance with the monetization terms then in effect, subject to setoff for amounts owed to Vizno or for chargebacks and refunds;
- provisions that by their nature should survive termination will survive, including those identified in Section 23.
We may, in our discretion, retain Creator Content offline for the purpose of complying with legal obligations, defending legal claims, or enforcing our rights.
16. Modifications
We may modify these Creator Terms from time to time. We will provide notice of material changes through the Service or by email at least 14 days before the change takes effect, except where a shorter notice period is required by law or appropriate due to a security or compliance issue. Your continued use of the Service as a creator after the effective date of revised Creator Terms constitutes acceptance of the changes. If you do not accept the changes, your remedy is to terminate your creator account.
17. Compliance with law
You will comply with all laws, regulations, and government orders applicable to your activities under these Creator Terms, including without limitation laws and regulations regarding:
- consumer protection;
- intellectual property;
- data privacy and protection;
- export control and economic sanctions;
- tax;
- adult content (where applicable);
- advertising, sponsorship, and disclosure of paid placement.
18. Force majeure
Neither party is liable for delays or failures arising from causes beyond its reasonable control, including natural disasters, strikes, war, terrorism, government action, internet or telecommunications outages, or failures of third-party service providers.
19. Assignment
You may not assign or transfer these Creator Terms, in whole or in part, by operation of law or otherwise, without our prior written consent. We may assign these Creator Terms in connection with a merger, acquisition, financing, reorganization, or sale of assets.
20. Governing law and dispute resolution
These Creator Terms are governed by the laws of Michigan, without regard to its conflict-of-laws principles.
Any dispute arising out of or relating to these Creator Terms or your use of the Service as a creator will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration will be held in Kalamazoo, Michigan or as the parties otherwise agree. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
YOU AND VIZNO EACH WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE PROCEEDING. Disputes will be brought on an individual basis only, not as a class, consolidated, or representative action.
You may opt out of this arbitration provision by sending written notice to legal@vizno.app within 30 days of first agreeing to these Creator Terms.
Notwithstanding the foregoing, either party may seek temporary or preliminary injunctive relief in a court of competent jurisdiction to protect intellectual property or confidential information.
21. Entire agreement
These Creator Terms, together with the Vizno Terms of Service, the Privacy Policy, the Content Policy, and any monetization-specific terms incorporated by reference, constitute the entire agreement between you and Vizno regarding your role as a creator. If any provision is held unenforceable, the remaining provisions remain in effect.
22. Notices
Notices to Vizno must be sent to:
- Vizno LLC
- [Mailing address]
- legal@vizno.app
Notices to you will be sent to the email or in-platform contact address on file for your creator account. You are responsible for keeping that information current.
23. Survival
The following provisions survive termination of these Creator Terms: Section 4.3 (Feedback), Section 5 (Representations and Warranties) for any obligation accrued before termination, Section 7 (Prohibited Content) for any obligation accrued before termination, Section 11 (Indemnification), Section 12 (Disclaimers and Limitation of Liability), Section 13 (Audit Rights), Section 14 (Confidentiality), Section 15.3 (Effect of Termination), Section 20 (Governing Law and Dispute Resolution), and any other provision that by its nature should survive.
